Welcome to Davika Design. The terms “we”, “us”, and “our” refer to Davika Design. We operate this digital atelier and store, including all related information, curated content, and bespoke products (collectively, the “Services”) to provide you with an unparalleled shopping experience. Davika Design is powered by Shopify, which provides the foundational technology for our Services.

By interacting with our boutique or commissioning a piece, you agree to be bound by the following Terms of Service (“Terms”) and our Privacy Policy. Please read these Terms with care, as they outline your legal rights regarding warranties and liabilities.

Section 1: Access and Elegance

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction. To engage our Services, you may be asked to provide certain information, such as your email, billing, and shipping details. You warrant that all information provided is accurate and complete. You are solely responsible for the security of your account and all activity occurring therein.

Section 2: Our Artisanal Products

We make every effort to display our collections with absolute fidelity. However, as our pieces are handcrafted, please note:

  • Visual Representation: Colors and textures may appear differently depending on your device’s configuration. We cannot guarantee that your screen will perfectly capture the physical brilliance of our materials.

  • Artisanal Variance: We do not warrant that the quality of products will perfectly mirror digital renderings, as slight variations are the hallmark of bespoke luxury.

  • Exclusivity: We reserve the right to limit quantities or discontinue any piece at our sole discretion.

Section 3: The Order and Commission

When you place an order, you are making an offer to purchase. An order is only accepted once Davika Design confirms it in writing.

  • Personal Use: You represent that your purchases are for personal or household use only and not for commercial resale or export.

  • Made-to-Order: Because our rugs are commissioned specifically for you, please review your selection carefully. As noted in our Return Policy, cancellations are subject to specific timeframes and fees once the piece has been committed to the loom.

Section 4: Pricing and Fine Billing

Prices and promotions are subject to change without notice. The price for your acquisition will be the price in effect at the moment of order placement.

  • Exclusions: Unless expressly stated, prices do not include taxes, white-glove shipping, handling, or international customs duties.

  • Payment: You represent that you are authorized to use the chosen payment method and that all charges will be honored by your financial institution.

Section 5: Shipping and Passage of Risk

While we partner with elite couriers, all delivery times are estimates only. Davika Design is not liable for delays caused by carriers, customs processing, or global events. Title and risk of loss pass to you upon our transfer of the product to the carrier.

Section 6: Intellectual Property

The Davika Design brand, including all imagery, designs, text, and trademarks, is the exclusive property of Davika Design and is protected by international intellectual property laws. You are granted a limited license for personal, non-commercial use only. Any reproduction or distribution of our designs without prior written consent is strictly prohibited.

Section 7: Third-Party Relations

Our Services may feature optional tools or links provided by third parties (including Shopify). We provide access to these "as is" and without endorsement. We assume no liability for your interaction with third-party resources or websites.

Section 8: Feedback and Submissions

Should you provide us with feedback, reviews, or suggestions ("Feedback"), you grant Davika Design a perpetual, worldwide, royalty-free license to use and display such content. We reserve the right to curate or remove any Feedback that we deem inappropriate or offensive.

Section 9: Relationship with Shopify

Davika Design is powered by Shopify. However, your contract of sale is directly with Davika Design. You acknowledge that Shopify is not responsible for any aspect of the transaction, and you hereby release Shopify from any claims arising from your purchase.

Section 10: Disclaimers and Limitation of Liability

  • No Warranty: Except as expressly stated, the Services and all products are provided "as is" and "as available," without any warranties of merchantability or fitness for a particular purpose.

  • Liability: To the fullest extent permitted by law, Davika Design, our directors, and our partners shall not be liable for any indirect, incidental, or consequential damages (including lost profits) arising from your use of the Services or any products procured through us. Our maximum liability shall not exceed the original purchase price of the product.

Section 11: Indemnification

You agree to indemnify and hold harmless Davika Design and its affiliates from any claims, losses, or legal fees arising from your breach of these Terms, your violation of any law, or your misuse of our Services.

Section 12: Severability and Governing Law

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect. These Terms are governed by the laws of the jurisdiction where Davika Design is headquartered. You consent to the exclusive jurisdiction of the courts therein.
